16-year-old girl sexually assaulted in Nairobi’s Embakasi estate
A 21-year-old man based in Nairobi’s Embakasi estate has been charged with defilement after it emerged that he had sexually assaulted a 16-year-old girl whom he had reportedly ‘wedded’.
Simon Mutuli Mwaka, a mason by profession, is alleged to have committed the indecent act at his Embakasi home on November 26, 2023.
He also faces another charge of engaging in an indecent act with a minor.
The suspect, who was in the company of his supposed wife, was apprehended by police on November 27 before being taken to Mama Lucy Kibaki Hospital where a quick medical probe established that the minor had been defiled, leading to Mwaka’s remanding.
The minor, a Kitui County resident, eloped with Mwaka a few days before his arrest.
The minor’s mother was reportedly aware that her daughter was romantically involved with the mason since she occasionally used her phone to communicate with her supposed lover.
After arriving in Nairobi following their elopement, Mwaka reportedly phoned the girl’s mother to inform her that they were living together as man and wife.
When the girl’s mother informed her husband, the minor’s father reported the matter to Tassia police station before leading officers to Mwaka’s home where he was arrested.
When Mwaka was presented before Makadara Principal Magistrate Erick Mutunga, the girl reportedly wanted to retract the charges but the court did not allow it since she was not of age.
Mwaka was subsequently freed on a surety bond of Ksh.150,000. His case will be mentioned on January 25, 2024.
